Scope
These General Terms and Conditions apply to all contracts between SAGAS UG (haftungsbeschränkt) (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer") for the purchase of building materials. Deviating conditions of the Customer are not recognized unless the Seller has expressly agreed to them in writing.
Conclusion of Contract
The presentation of products on the website or in other sales channels is for informational purposes only and does not constitute a binding offer. A contract is only concluded when the Customer places an order by email or telephone and the Seller confirms this order or dispatches the goods to the Customer.
Prices and Payment Terms
All prices are quoted in Euro and include VAT as well as any applicable shipping costs. Payment is made by bank transfer or cash on pickup. The invoice amount is due within 5 days upon receipt of the invoice, unless otherwise agreed.
Delivery and Shipping
Delivery is at the expense and risk of the Customer. The delivery time is usually up to 7 working days from receipt of payment, unless otherwise agreed. Partial deliveries are permissible if reasonable for the Customer. The risk of accidental loss and deterioration of the goods passes to the Customer upon delivery to the Customer or a recipient authorized to receive them.
Retention of Title
The delivered goods remain the property of the Seller until full payment has been made.
Warranty and Liability
The statutory warranty provisions apply to defects in the delivered goods. The Seller's liability for damages resulting from injury to life, body, or health as well as for damages resulting from grossly negligent or intentional breaches of duty by the Seller remains unaffected. Otherwise, the Seller is only liable for damages resulting from intentional or grossly negligent breaches of material contractual obligations (cardinal obligations) by the Seller or its vicarious agents.
Data Protection
The Seller collects, processes, and uses personal data of the Customer only within the scope of legal regulations. Further information on data processing can be found in the Seller's privacy policy.
Final Provisions
German law applies to all contracts with exclusion of the UN Convention on Contracts for the International Sale of Goods. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of business.
These General Terms and Conditions may be amended by the Seller at any time without separate notification. The current version of the T&C is available on the Seller's website. If individual provisions of these T&C are or become invalid, the validity of the remaining provisions shall remain unaffected.
